#OccupytheCourts with me this Winter

Just before I #OccupytheJails ;-)

KEENE – The big show now has dates so my allies at Fr33 Agents made the following events for me on Facebook. According to the event page:

According to Barbara Hogan, the Clerk of Court, Talley is “Ordered to appear for the following event at Cheshire Superior Court and that “FAILURE TO APPEAL as scheduled will result in bail forfeiture and an arrest warrant issued for defendant’s arrest.”

Threats, backed by violence, made by the State to a peaceful member of the independent media who got too close to the court with his camera. Join Jason on November 22nd and witness the violence inherent in the system.

Talley is charged with Contempt of Court, Disorderly Conduct, Resisting Arrest or Detention in the lobby of the Cheshire County Courthouse. He has plead of NO VICTIM, other than himself.

Because there will be a jury trial I have decided to show up for these dates as long as a few stipulations are granted by the church court. But more on this in a few blog post. If you live in the Shire, especially Keene, you are encouraged to attend and learn more about what the State does to peaceful people who intend to make government more transparent. People like me. Two court bailiffs already assaulted me and now State Agent John Webb intends to punish me further with up to 6 months in a cage at a corrections facility. I don’t need to be corrected, the system needs to be corrected.

State v. Talley.TV Jury Trial Scheduled for January 9th

KEENE – I received a piece of mail from some people calling themselves the State of New Hampshire. It contained orders and threats if I didn’t follow their orders. The letter revealed that a jury would be seated for this trial as early as January 9th. Here are the dates:

2011 NOV 22 10am Preliminary Pretrial
2011 DEC 20 11am Final Pretrial
2012 JAN 09 09am Jury Selection
2012 JAN 09 – 17 Jury Trial

I have less than a month to prepare for my preliminary pretrial hearing. Before November 22nd I’ll need to prepare at least two motions before I step foot inside the Cheshire County Superior Court for the first time since my assault by two court bailiffs. The first motion will inform the court that I will remain seated. The next will seek permission to record all of my interactions with public servants in the Cheshire County Superior Court. In addition to transparency, this will also provide increased safety for me in a place where I’m vulnerable to assault and kidnapping by men wearing badges.

Will Beau Davis Be Caged 3 – 7 Years For the Distribution of Plants?

KEENE – That plant is known as cannabis and in the “Live Free or Die” State of New Hampshire a young man could be caged for up to 7 years if he dares compete with the very profitable Liquor Cartel. Beau’s official charge of “distribution of controlled substances” was announced at Keene District Court this morning at 9:30 am. At the same time all over the State, employees of the New Hampshire Liquor Commission exchanged money for alcohol. These employees will go home to their families while Beau is separated from everything and everyone he knows.

Beau Davis moved to the Shire as a crew member of Liberty on Tour during their Free State Friendship Tour. He hopes to travel more in the future, perhaps on the Oceans. Beau is known for his kindness and peaceful actions.

According to eyewitness accounts, Beau was arrested before 3:30 while standing near a group of people in Keene Central Square. A Keene Police Department Cruiser parked on the cross walk in front of the church. A uniformed officer asked Beau if “Davis” was his last name. Beau replied with “huh” as two male law enforcers, one in uniform and one out of uniform, put their hands on Beau before taking him away. The Keene Police Department or the Drug Task Force are not releasing information on the subject.

When asked what the charges against Beau are, the law enforcers replied “none of your business.” These law enforcers enforce prohibition which makes victims out of peaceful people and the taxpayers who are forced to fund their aggression.

Beau still refuses to process and is likely being denied food, warmth and contact with people who care about him. There may be a video arraignment later today. The courtroom was full and 10 people from the Keene community were there to see Beau. One woman was wearing an “I Support Beau” t-shirt.

Bob Constantine’s Update on Nurse Patricia Appeal to the NH Supreme Court

Thanks to Bob and Brooks Constantine for spending the day with me to record the New Hampshire Supreme Court. We joined over 500 government school kids to hear an appeal by Patricia Smith’s lawyer, Marc Sisti, asking that she not be locked in a New Hampshire cage. Employees of “the State” intend to lock Nurse Patricia in a cage for 2 – 4 years because she grew plants that the State deems ILLEGAL – so illegal that taxpayers will be funding the work of the Women’s State Prison to “correct” a peaceful woman.

Nurse Patricia believes she owns her body and that it isn’t owned by some legal fiction that individuals call the State of New Hampshire (or the court, the cops, the Ku Klux Klan, Al-Qaeda or any other conspiracy to make other people miserable. All of these organizations use violence to achieve their goals so they don’t have my support).

As Bob points out in the video above, Nurse Patricia was forced to give the U.S. Federal Government $51,000 so that she could keep her house.

Laura Kiernan produced today’s “On the Road” session of the New Hampshire Supreme Court and made it easy for me to record it. Power was supplied as well as a choice location. Supreme Court’s 13th “On the Road” session set for October 20
at Moultonborough Academy

CONCORD, October 14, 2011 – The New Hampshire Supreme Court’s annual “On the Road” special session will be held on October 20 at Moultonborough Academy. More than 500 students from 11 high schools in the area are expected to attend the event, which includes an informal question and answer session with the lawyers appearing before the court and with the justices themselves.

Since 2002, the members of the Supreme Court have traveled to a different location around the state to provide high school students with a unique opportunity to learn about the court and how it works and talk with the justices about their background and their careers.

The moderator for the Supreme Court special session will be Merrimack County Superior Court Judge Larry M. Smukler. Seating is reserved for students from participating schools; 20 seats are available to the public on a first-come first-served basis.

Prior to the October 20 special session, during which the justices hear oral argument on actual Supreme Court cases, volunteer lawyers visit each of the invited schools to discuss in advance with teachers and students the legal issues and proceedings involved in the cases that will be heard by the court. The same protocols used at the Supreme Court in Concord during oral argument will be followed during the session at Moultonborough. After each case is heard, the lawyers involved take questions from the student audience about the cases they have just presented.

In addition to students from Moultonborough Academy, students from the following schools are also participating in the October 20 program: Kingswood Regional High School; Laconia High School; Inter- Lakes High School; Prospect Mountain High School; Winnisquam Regional High School; Laconia Christian School; Belmont High School; Franklin High School; Tilton School; and New Hampton School.

Lawyers who volunteered to visit the participating schools to brief students on the two cases to be heard by the court are: Former New Hampshire Attorney General Philip T. McLaughlin; Assistant Attorney General Jane E. Young; Attorneys Paul A. Maggiotto of Concord; Joshua M. Wyatt and Kristin R. Blanchette of Manchester; Dorcas J. Gordon of Laconia, and Jeremy D. Eggleton of Concord; Belknap County Attorney Melissa Countway Guldbrandsen and assistant Belknap County Attorney Benjamin E. Leduc; public defenders Donna J. Brown and Stephanie Hausman; and assistant U.S. Attorney Michael McCormick.

The “On the Road” program was launched in May 2002 at St. Anselm College in Manchester. Since then, sessions have been held at Dover High School, Dartmouth College, Plymouth State University, Keene State College, Nashua North High School and Philips Exeter Academy, Berlin Junior High School, Bow High School, Souhegan High School, Memorial High School and Sanborn Regional High School. These sessions are the only occasion when the Court convenes outside the Supreme Court building in Concord. Approximately 5,500 high school and college students have participated in the program since it began.

In the first case to be heard by the Supreme Court during the special session, State of New Hampshire v. Roderick Davidson, the justices have been asked to consider whether the defendant was denied his constitutional right to a fair trial because the jury in his case was allowed to hear evidence about the defendant’s controlling behavior toward the victim. The defendant, who was convicted of three counts of misdemeanor simple assault, also contends that his action toward the victim was justified under the law because he says he was trying to prevent her from taking his property, in this instance his car keys.

In the second case to be heard by the justices during the special session, State of New Hampshire v. Patricia Smith, the defendant argues that local law enforcement officials violated her constitutional right to privacy and protection from unreasonable searches when they conducted a stakeout in a wooded area behind her home. Local officials had received a tip that the defendant was growing marijuana at her home and they obtained a search warrant for the house after detecting the odor of growing marijuana during the surveillance. The defendant, who was convicted of manufacturing marijuana, contends the evidence found in her house should have been thrown out of court because the officials should have obtained a search warrant before they came onto property that was close to her house.

Supreme Court Hears Nurse Patricia Tomorrow

GRAFTON – Tommorrow morning New Hampshire’s Supreme Court will hear the appeal of Patricia Smith, a nurse who will likely spend years in a cage for growing plants in her home. The plants in question were cannabis and, in New “Live Free or Die” Hampshire, if you grow it you may have law enforcers enter your home at night where they’ll watch you go to the bathroom and steal money from your purse. That’s what happened to Nurse Patricia.

I think we can treat our peaceful neighbors better than this.

Bob and I feel a lot of empathy for Nurse Patricia, her daughter Kelly and mother Rita. Many are silent during acts of state aggression while others serve as witnesses. OccupyNH General Assembly Invokes “Right to Revolution” from NH Constitution

Yesterday at Occupy NH’s General Assembly there was broad support for Article 10 of New Hampshire’s Constitution. As you can see in this video, the occupiers discussed what to do in the likely case that law enforcement uses agression against them. Police have threatened to remove the occupiers and their property tonight at 11PM. One person suggested locking arms, another read Acrticle 10 to a very supportive crowd:

Here is Article 10 from the New Hampshire Constitution:

Government being instituted for the common benefit, protection, and security, of the whole community, and not for the private interest or emolument of any one man, family, or class of men; therefore, whenever the ends of government are perverted, and public liberty manifestly endangered, and all other means of redress are ineffectual, the people may, and of right ought to reform the old, or establish a new government. The doctrine of nonresistance against arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.

Each New Hampshire law enforcer swears an oath to follow the New Hampshire Constitution. Let’s see what they decide tonight.

NEW YORK CITY – After a 5 hour drive from Keene, Ryan Maddox, Michele 7, Derrick J. Freeman and I set up our Fr33 Agents HQ at a swanky nearby hotel that we joked was probably inhabited by the 1%. My mission was to report on the other 99% who filled Liberty Plaza near Wall Street to… well, that’s what I wanted to learn more about.

Thanks to Michele for providing transportation and to the Civil Disobedience Evolution Fund (and their supporters) for providing the funds for gasoline. [PHOTOS]

Yesterday we were able to arrive in New York and meet up with some local allies. We scouted occupied Wall Street and the ignored Federal Reserve building, made signs, set up our nearby HQ.

People have been easy to talk to, except for the several law enforcers who investigated us because we had cardboard signs. Many different points of view are represented, including a few folks who want an end to the Federal Reserve.

Talley.TV to Report on #OccupyWallStreet

Is #OccupyWallStreet on the front-lines of freedom or is it a harbinger for the second term of the Obama Administration? I’m going to go with a crew of Fr33 Agents from the Shire to find out.

I haven’t been satisfied with the media accounts that I’ve seen (like the guy pictured to the right) so I’m going to go to Wall Street myself and report back with what’s really going on. I plan to have a lot of conversations with the “99%” who care about something so much, they have traveled long and short to Liberty Plaza in New York City. But Why? I want to be able to answer that question.

The following was reported as the Declaration of the Occupation of New York City which was ”unanimous[ly]” voted on by all members of Occupy Wall Street on Sept 29 around 8pm.

The Declaration of the Occupation of New York City is “our first official document for release.”

As we gather together in solidarity to express a feeling of mass injustice, we must not lose sight of what brought us together. We write so that all people who feel wronged by the corporate forces of the world can know that we are your allies.

As one people, united, we acknowledge the reality: that the future of the human race requires the cooperation of its members; that our system must protect our rights, and upon corruption of that system, it is up to the individuals to protect their own rights, and those of their neighbors; that a democratic government derives its just power from the people, but corporations do not seek consent to extract wealth from the people and the Earth; and that no true democracy is attainable when the process is determined by economic power. We come to you at a time when corporations, which place profit over people, self-interest over justice, and oppression over equality, run our governments. We have peaceably assembled here, as is our right, to let these facts be known.

They (the people who unanimously agreed to this declaration) then go on to describe gripes against a “they” that is mentioned 23 times referring to corporations. It is anti-corporate while ignoring the fact that the legal fiction known as the state creates legal fictions known as corporations. Take care of one and you take care of the other. Plus, your tax dollars aren’t being paid to pepper-spray your friends. I will find solidarity with those who don’t want to use State violence to achieve their goals. Many of these goals are laudable – no borders, for example, but many of them call for a larger role for the State and that means more guns pointed at all of us. No thanks.
