Another Casualty in the Government’s War on Cameras: Me!

The following was written on Saturday, September 24th using a pencil and paper provided by a “Corrections” Officer at the Cheshire County Department of Corrections.

Cecilia, Kate and I entered the Cheshire County Superior Courthouse at around 8:30AM on Friday, September 23rd. My mission that morning was to report on the Habeas Corpus Hearing for Ian Freeman. Ian is the host of the nationally-syndicated radio show Free Talk Live and is the founding blogger at FreeKeene.com.

Truth be told, I didn’t want to record the hearing for several reasons. First, I’m just returning from Connecticut where I was recovering from a nasty case of the flu. Still not feeling 100%, I arrived in Keene after 4PM on Thursday and learned that no one else was planning to record the hearing. That’s the second reason. The third is that I don’t like the anxiety that I feel when I think about video recording in the Cheshire County Superior Court. It’s speculation on my part but it is likely that many people feel similarly terrorized when doing something as simple as peacefully recording public servants in this particular government building. I don’t like living in fear so I decided to record despite the recent threats made by Judge John Arnold of the Cheshire County Superior Court. I shouldn’t have to be afraid, especially when I’m doing what’s right – like making the government more transparent by recording and reporting on the actions of public servants. After learning on Thursday night that no one had plans to record Ian’s hearing the following morning, I told James Schlessinger Jr, the producer of Free Keene TV, that I would not be recording Ian Freeman’s hearing.

Using a recording device (audio, video, photo) to report on government activities in this particular courthouse would likely result in hired men stealing the reporter’s equipment and/or their freedom. It could also result in a reporter being dragged across the floor by handcuffs and being locked in a cage for more than three days of solitary confinement.

That’s what happened to me, and I’ll detail that story more in a future report.

By Friday morning, I ended up deciding to record after reigning in my fear. I couldn’t allow myself to be pushed around by judicial terrorism. If I were in Ian’s place, I would have wanted someone to record my business with the court, so I decided to extend the same courtesy and record Ian’s hearing.

Upon entering the Cheshire County “Superior” Court with Cecelia and Kate, I exchanged my bag containing my gear for a ticket, and told the court security employee (CSE) that I would be audio & video recording. The CSE told me that I needed to ask permission 48 hours in advance. I planned to explain my circumstances (just arriving in Keene the previous night) on the motion to record with the Clerk of the Court at the nearby window.
I walked through the metal detector as instructed and my belt, as usual, set it off. I was checked by a handheld metal detector by the same man who a week prior hit my camera hard enough to make the battery fall out. This had happened outside the courthouse, on the sidewalk.

When he observed my belt he took note of my wearable camera that was clipped next to the metal buckle. I explained what it was and continued to walk to the nearby clerk’s window to fill out the motion to record the 9AM hearing that was scheduled to begin in 30 minutes. But before I was able to write anything down I was assaulted by two court security officers.

I was quickly pinned against a wall as one grabbed for my camera, the size of my thumb, on my belt. I was able to get to it first and hold onto it against my chest with both hands. This was when they handcuffed me. At some point I asked an empty court clerks window for a form to receive permission to record the hearing. No answer. After a handcuff was locked on my left wrist, my arms were forced behind my back and the right wrist was also shackled. I then dropped to my knees and sat down, resolute that I would not be assisting these two hired men in my own kidnapping. They were the ones committing aggression against a peaceful reporter so they would be the ones responsible for their violence.

The man hired by the court who had previously damaged my high definition camera was now dragging me by the handcuffs behind my back across the courthouse lobby. I don’t remember making any noise at this point but Kate must have seen the pain on my face and told the agressive court staff that they were causing me extraordinary pain.

The court employee got me into an elevator where I reminded him that he was violating his oath to the U.S. Constitution by infringing on my 1st Amendment rights (in addition to the NH Constitution and other laws). He and I went down one floor where the Cheshire County Sheriff’s Department is located. There, four deputies were waiting. I was told to stand up by one of these deputies and I replied that they would not receive any assistance from me. The four of them picked my handcuffed body up and took me to a holding cell where they set me on the floor next to a toilet. One of the deputies, in plain clothes, kicked me in the ribs before locking me in the cage, where I spent seven hours in isolation.

The court, and I presume the Sheriff’s Department, closes at 4PM so deputies picked me up and put me in a wheelchair. They then loaded me into the back of one of their vehicles and drove me to the Cheshire County Corrections Facility where I would spend the rest of the weekend and much of Monday. Dave Ridley: Keene Judicial Abuses Mount

Dave Ridley interviews Jason Repsher who discusses the recent abuses by the District and Superior Courts in Keene, NH. This report doesn’t cover my recent recording arrest which took place after this interview but it serves as a good overview of the other abuses by area courts.

From Ridley:

Keene judicial abuses mount. Fibbing judge caught on tape, insistence on ignoring higher court rulings, arrests over hat-wearing… All provide New Hampshire liberty activists an opportunity to push back against The Man. But how much more could be done?

The “fibbing judge” Ridley is referring to is Judge Edwin Kelly who charged Ademo of Cop Block with “Improper Influence” for asking him questions. Burke told his hired security detail that:

This person is threatening me for a decision I just made

So they falsely arrested Ademo based on Judge Burke’s false report and had him put in a cage for 2 days and wouldn’t release him unless a $5,000 ransom was paid. He was later released. This was followed by new recording restrictions in Keene area courthouses that have a chilling effect on the freedom of the press.

I’m Free(r) Now. Thank You!

On Friday at 9AM I was attacked by two hired men employed by the Cheshire County Superior Court because of a camera clipped to my belt. More accurately, because they were told to attack people with cameras. As silly as it sounds, the government is waging a war against cameras: the best tool to provide much-needed transparency to monopoly governments.

But I’ll have a court case where the State will attempt to “correct” me by making me spend more time in a cage for daring to record public servants. I’ll provide much more extensive coverage soon but for now I’d like to thank everyone who supported me following this act of state aggression.

Hannah Hoffman was there retrieving information and posting it right here on Talley.TV and on Facebook. She normally edits my blog posts but she took over reporting duties after I was caged. She’s also an excellent girlfriend.

Thanks to Mike Barskey from Mail-to-Jail.com for letting me call him at the expense of $3 an hour. Not only does he provide free mail services to prisoners but he was there for me when I needed to reach the outside world.

Derrick and Cecelia spent long hours in and out of courtrooms. Cecelia drove me home and Derrick recorded my video arraignment and release from the “corrections” facility.

Kate Ager provided her firsthand account of my assault and kidnapping on FreeKeene.com and posted updates. She was also there during the arrest and peacefully spoke up when I was being harmed by rouge bailiffs.

Mandrik made me an awesome dinner. Lots of times, a newly released prisoner is treated to a meal out but we kept this one in the agora. It makes more sense not to pay the state a sales tax funding the continued caging of peaceful people (like me!). The food was so delicious, especially compared to taxpayer-funded meals the corrections facility delivered to my locked door.

There were lots of phone calls made to the jail, and information shared via social networks and elsewhere. I’ll post more examples of this soon but it made me feel great to see that so many people have my back. So thanks to you!

Update on Jason Talley’s Arrest, Part 2

I just got off the phone with a Sargent at the Cheshire County Jail, and he informed me that Jason has processed! I’m very happy to hear this because it means he will not have to sleep on a cold slab of concrete and do his business in front of all the guards. It also means he will get to mingle with Ian Freeman, who is also doing time in the Cheshire County Jail. The Sargent told me he will be classified next week, probably on Tuesday.

Jason is being charged with “common law criminal contempt” and last I heard his arraignment is scheduled for Monday at the Superior Court in Keene, NH. I tried calling the court yesterday and today to get confirmation about his arrest and arraignment, but I assume no one will return my calls until Monday when they reopen.

Update on Jason Talley’s Arrest

I was just informed that Jason is being held in a cage until his arraignment on Monday morning. Apparently he is refusing to process. Kate Ager from FreeKeene.com announced that there will be video taken at his arraignment, which I will repost here as soon as it becomes available.

Jason Talley Arrested at Keene Superior Court

I just learned that Jason Talley was arrested this morning at the Superior Courthouse in Keene, NH. The reason for his arrest is unclear, but Kate Ager provides us with some details at FreeKeene.com:

This morning (September 23, 2011) around 8:40 AM, Jason Talley, Cecelia, and I went to the Superior Courthouse in Keene for Ian Freeman’s habeas corpus hearing scheduled for 9:00 AM. At the ‘security’ checkpoint, Jason checked his bag of recording equipment in exchange for a receipt. He then walked through the metal detector and was immediately questioned about the device attached to his belt. Jason replied, “That’s my personal camera,” then expressed that he was walking to the window a few feet away to fill out a form asking permission to film the proceedings upstairs.

As Jason approached the window, the bailiffs began touching him. At first it appeared that the bailiffs were patting down his pockets, but they then attempted to steal his camera from his belt. Jason held onto his property while the bailiffs were grasping his wrists, very tightly it appeared, and trying to pull his hands away from the camera. Jason was told he was under arrest and put into handcuffs. Although he did not resist, Jason did not assist the bailiffs in his kidnapping. One of the bailiffs grabbed onto the handcuffs, in the center, and dragged Jason, backwards, into the elevator.

The bailiff, when questioned, stated that Jason was going to be seen in Keene District Court on two misdemeanor charges, including resisting arrest. He would not state the specific charge for which Jason was arrested, only that it was in relation to walking through security with a recording device. Cecelia and I went to the Keene District Court to inquire about when Jason would be seen by the judge, but the clerk was not able to provide any information.

At the Cheshire County Sheriff’s Department (located in the Superior Courthouse), we were informed that Jason would be seen by a judge this afternoon. We then spoke with the County Attorney and learned that Jason will be seen “sometime after 1:30 PM” this afternoon at the Superior Courthouse.

Government Drops Charges for the Jefferson 5 Dancers

Adam Kokesh, Eddie Free, Jared Denman and Medea Benjamin had their charges dismissed by “the State” for dancing at the Thomas Jefferson Memorial. Via Eddie Free:

Prosecution to Judge: “Government wishes to drop charges”
Judge to Defendants: “any objections?”
Defendants: “No”
Judge: “case dismissed, good job guys!”

To quote Thomas Jefferson: “If a law is unjust, a man is not only right to disobey it, he is obligated to do so.”

LIVE: Derrick, Ryan & Roz Get Some Accountability from the City of Keene

On Friday evening the City of Keene sent the night shift of the Keene Police Department to Central Square where law enforcers stole an audio mixer and assaulted three people participating in the community’s Live Free or Dance event. Derrick Freeman was maced while law enforcers attempted to blind the cameras from the actions of their aggressive colleague with their flashlights.

Each of these organizations are subject to the Freedom of Information Act (FOIA) and this morning is the first available chance for the FOIA to be evoked.

For any members of law enforcement who may be thinking about stopping my efforts to make government more transparent I suggest you read about the recent Glik ruling by the 1st Circuit U.S. Court of Appeals here and here. It upheld the right to record public servants and makes it clear that people who are law enforcers can be personally held liable for for infringing on rights acknowledged by the First Amendement to the U.S. Constitution. Words on paper that law enforcers swore to uphold. From the unanimous three judge ruling (PDF) by the  1st Circuit U.S. Court of Appeals:

[A] citizen’s right to film government officials, including law enforcement officers, in the discharge of their duties in a public space is a basic, vital, and well-established liberty safeguarded by the First Amendment.

Lets see if they want to challenge the U.S. District Court today?

Police Use Violence to Shut Down “Live Free or Dance”

KEENE – A peaceful and fun evening for the Keene community devolved into chaos when law enforcers, employed by the city of Keene, showed up to make threats and eventually kidnapped three people, Ryan Maddox, Roz and Derrick Freeman.

I was in Central Square to dance but instead my evening was spent livestreaming the violence that is unfortunately becoming more commonplace with militant law enforcers “just doing their jobs.” I was able to broadcast the following seven video playlist live:

Police interrupted the celebration in Central Square at around 10:15. According to Jason Repsher, “The music had only been playing for a minute and it wasn’t very loud.” [Video: Live Free or Dance Begins Peacefully] Keene native Jacqueline Lemieux commented on a Keene law enforcer’s claim that ‎”a citizen complained” about the noise:

That is a flat out lie. The music had just been turned on and I was walking in front of The Stage and over towards the common and was not able to hear any music at all until I arrived a few feet from the gazebo. KPD is quickly developing a habit of lying and abusing its public and I will not stand for it!

Jason Repsher stated in the description of the video he recorded (below) that:

The cops make up a story that they were called because of a complaint and the cops insist on permits and licensing in order to play music in the park. The cops wanted someone to claim the equipment so they could check ID.

Repsher continues:

The cops knew it wasn’t his, but apparently the kid had gotten into trouble earlier in the night and they wanted a reason to arrest this kid. After the kid was arrested and hauled off, the cops proceed to take it upon themselves to seize the equipment. At which point, Derrick Freeman, Ryan Maddox and Roz get arrested in the attempt to prevent the property from being stolen by the Keene PD (for holding onto the property while the cops pry it away). After Derrick Freeman is handcuffed one of the officers maces and puts him in the patrol car. In the video you can see the officer shake his pepper spray at which point two officers come over and attempt to block my video.

When you watch the above video take note of how at least two law enforcers shine their flashlights at cameras just before Derrick gets maced. It seems obvious that they were attempting to censor the recording of their violent colleague. It’s unknown if this technique is taught during their training, is department policy or just the actions of two law enforcers who want to hide their aggressive actions from the public.

Another witness, Nick Ryder, posted the following on the Free Keene Forum along with his video:

1. Police show up on a noise complaint and inform people to tear down the lights, speakers, etc and not use city power.
2. Police ask who owns the equipment. Nobody answers.
3. After a while, random other guy (non-activist) claims to own them. He is arrested.
4. Police come to confiscate said equipment under the baseless claim that random guy owns it.
5. Derrick contests the claim, saying he owns it, and does not let the police take it.

All three were eventually released after many hours in solitary confinement. There are reports that Derrick was able to continue the dance party at the Cheshire County House of Corrections for four hours. He was able to eventually able to return home to shower out the mace before going to work. Stay tuned for more information about future court dates and danceobedience.

The State vs. Kate, one of the Chalking 8

No Victim No Crime

When Kate Ager stumbled upon a pro-police accountability rally in Manchester she didn’t expect to get arrested. Nevertheless, three armed law enforcers employed by the Manchester Police Department put their hands on her and forced Kate to the ground. Her cry to “Get the fuck off of me!” was ignored by the men who act as if their badges grant them extra rights (see CopBlock.org/Chalk). Because she was standing on the sidewalk that had been chalked earlier in the day the law enforcers had ordered her to move. 30 seconds later she was being forced inside the Manchester Police Department in chains.

Kate spoke to Talley.TV about her treatment and encouraged people to attend her trial on Monday (details below) which is the first for the “Chalking 8.” She outlines her defense plan but seems to realize the difficulty in receiving “justice” from the same organization that employs the law enforcers, prosecutors and judges. The person who will wear the black robe in Kate’s case was once a law enforcer and prosecutor within the State of New Hampshire.

Despite the harm done to the activists, aggressive police tactics help underscore why there was a pro-police accountability rally at the Manchester Police Department to begin with. Awareness is being raised about the killing of James Breton and the beating of Christopher Micklovich by people employed by the Manchester Police Department and that’s a good thing.

When she arrived at the Manchester Police Department, Kate encountered some already agitated law enforcers who took little time to use aggression against her. Manchester law enforcers arrested eight people and seized nine cameras/phones that day which should bother anyone who supports transparency in government.

Despite the confiscation of cameras, Dave Ridley captured the arrest of Kate Ager because, luckily, he was across the the street:
